A dispute arose between two siblings living together in their family home in Kuwadzana, Harare. The older sister, Viola Mazviwanza, applied for a peace order against her younger brother Given.
Viola accused Given of verbally abusing her and inviting strangers over to use some rooms in their family home as an unlicensed bar or lodge. She pleaded with the magistrate to issue a peace order, arguing that without it their family home inherited from their parents would be turned into an unlicensed bar or lodge.
Given did not oppose Viola’s application. He told the court that his sister mistreated him because he was younger, unemployed and she supported his child. He admitted to smoking marijuana and wanted rehabilitation. Given claimed Viola was wrongly accusing him, saying they had only quarreled over the TV channel.
The magistrate granted the peace order with the consent of both parties. The magistrate ordered Given to abstain from drugs, make amends with his sister and stop bringing strangers to their family home. The peace order was issued to maintain peace between the siblings and protect their shared property.
