Bulawayo – In a bizarre incident that has rocked Bulawayo, two men were apprehended in the early hours of the morning engaging in anal sex in the city’s central business district.
Themba Nyoni (36) from Magwegwe and Mswazi Tshabalala (33) from Njube found themselves on the wrong side of the law after being caught red-handed by a vigilant security guard.
The incident unfolded on January 15, 2025, at approximately 2am, at a building situated at the corner of Leopold Takawira Street and Josiah Tongogara Avenue. The security guard, who was manning the premises, noticed Nyoni and Tshabalala lying on top of each other near the ground entrance of his workplace.
Upon closer inspection, the guard was reportedly stunned to discover that both men had their trousers and underwear pulled down to their knees. Instead of confronting the pair directly, the security guard sought out a passer-by to act as a witness to the unfolding scene.
Returning with the witness, the security guard found Nyoni and Tshabalala still allegedly engaged in anal intercourse. The guard promptly rushed to Bulawayo Central Police Station to file a report, prompting a swift response from law enforcement officers who arrested the two men.
Nyoni and Tshabalala subsequently appeared before Bulawayo magistrate Abednico Ndebele, where they faced sodomy charges. Both men pleaded not guilty and were remanded in custody until February 28, 2025, for the continuation of their trial.
In their defence, the accused claimed they were simply sleeping and that “nothing had happened,” asserting that they often slept in that location when it was late.
During his testimony, the security guard recounted the moment he discovered the two men. “While patrolling around 2am, I found the two accused persons engaged in anal sexual intercourse,” he stated. “Tshabalala was lying on his stomach, his trousers pulled down, while Nyoni was on top of him, performing the sexual act.”
The security guard emphasized the clarity of the scene. “I was standing about three metres away from them. There were lights, and it was clear. I went and called a nearby person, and we both witnessed them in the act. We then went to report to the police station,” he testified.
One of the police officers who attended the scene corroborated the security guard’s account. She testified that she received a report from the informant (the security guard), who was accompanied by another person, stating they had witnessed two men engaging in anal sex.
The police officer said they proceeded to the scene with the informants and five other colleagues. Upon approaching the location, the second informant reportedly exited the vehicle, expressing fear of being victimised by the accused.
“We arrived at the scene and found Tshabalala still lying on his stomach, and Nyoni lying on his right side, facing him. They were lying close to each other, and we woke them up,” she stated.
The police officer further stated that they noticed Nyoni woke up immediately, while Tshabalala took a long time to awaken, as if he was intoxicated.
Gwanda Man Jailed for 15 Years for Aggravated Indecent Assault
Meanwhile, in a separate case highlighting the issue of sexual violence, a 24-year-old man from Gwanda has been sentenced to 15 years in jail after being found guilty of aggravated indecent assault.
The perpetrator was sentenced by a Gwanda magistrate following a full trial. The National Prosecuting Authority (NPA) successfully proved that on January 24 this year, in Guyu, the offender engaged in non-consensual anal intercourse with the complainant, a 25-year-old male, while he was asleep.
The events leading up to the assault began in December 2024, when the offender approached the complainant, claiming someone was trying to bewitch him and offered to assist him with prayers to help resolve the issue.
“On January 23, 2025, the offender visited the complainant’s residence late at night, rubbed oil on his stomach and back, and both fell asleep,” the court heard. “The complainant woke up to find the offender sexually assaulting him.”
After confronting the offender, who warned him not to tell anyone, the complainant informed his parents, who advised him to report the incident to the police. The swift action of the complainant and his family ensured that justice was served in this disturbing case.
